The National Academy of Sciences (NAS), is a United States non-governmental organization that advises the federal government. The NAS recently met with groups from the World Health Organization and the United Nations, to discuss “harmonization” (meaning restriction) of “nutrient intake” recommendations.

Severe restrictions on vitamin doses in supplements are already well under way in the European Union. The European Food Safety Authority (EFSA) has discussed setting the maximum level for beta carotene in a supplement to the amount provided by half a carrot, and the maximum level of selenium to what is found in one-third of a brazil nut.

Until recently such restrictions in Europe would not have been an immediate cause for concern for people in the United States. Under current law – the “Dietary Supplement Health and Education Act of 1994” – the FDA (US Food And Drug Administration) should not be able to adopt restrictive standards behind closed doors without public involvement.

Current Federal law defines an adulterated supplement as a supplement that “presents a significant or unreasonable risk of illness or injury” either when used according to the product’s label or under ordinary conditions of use.

Recently, the FDA determined through a Guidance Document that certain bulk caffeine products were “adulterated” because they contained hundreds of potentially lethal doses. The FDA said that these products must either be diluted or sold in pre-measured packets.

The FDA made a determination through a Guidance Document, instead of through Rulemaking, about what an “adulterated” supplement is. Under Current Law, the FDA cannot be legally challenged for positions taken in a Guidance Document.

Might the FDA point to National Academy of Sciences (NAS) recommended upper limits on vitamins based on that group’s meetings with the Food and Agriculture Organization (FAO) of the United Nations in Rome?

Might the FDA turn around and say that any supplements containing doses above those upper limits are “adulterated” because they “present a significant or unreasonable risk of illness or injury”?

The involvement of the National Academy of Sciences (NAS) appears to be an initial phase of bringing the discussion of establishing upper limits for vitamins to the US, and they may be used by the FDA under the guise of “science” to suggest the US, too, should follow the flawed European approach to setting limits on vitamins.

The National Academy of Sciences (NAS) has proven definitively that, when it comes to supplements, it has no idea what it’s talking about. For example, the organization’s recommended daily allowance for vitamin D is 600 IU for adults; it’s upper level—that is, the level above which the organization said poses a danger to the individual—is 4,000 IU for adults. The Vitamin D Council, on the other hand, recommends 5,000 IU of vitamin D for adults, and other estimates are even higher.

In The Early 1990s this dramatic public-service ad (PSA) was developed. Federal agents equipped in full Special Forces gear, converge on Mel Gibson, in this now-famous cameo, who says, in defense as he holds up a supplement bottle: “Hey. Guys. Guys. It’s only vitamins.” This call-to-action video warned consumers that the Federal government is “actually considering classifying most vitamins and other supplements as drugs. The FDA has already conducted raids on doctors’ offices and health food stores. Could raids on individuals be next?” Near the end of the ad, as Mel Gibson’s character is being arrested, he says in desperation: “Vitamin C, you know, like in oranges?” While the video was a dramatization to be sure, it visualized a nightmarish scenario that was truly only one step away from reality at that time.
